Careless driving charge possible after driver leaves the scene
I was involved in an accident where the other driver said I hit him first when I didn't. The police interviewed me and have suggested they may charge me with careless driving - but how can they decide who hit who? Also I did not report the accident straight away. I went home to do it but the police were already at my house. Can they still accuse me of not reporting it?
Leaving the scene of an accident is never a good idea and while there is no requirement to report an accident which does not involve an injury to the police, the law requires you stop in all but the most exceptional circumstances and exchange information with the other driver(s) involved at the scene. That you failed to do so is an offence and you may well face charges. Leaving the scene may also shape the police's attitude and lead to additional charges being brought against you.
