Caught on CCTV for parking with two wheels on the kerb while loading to avoid blocking the road: can I appeal the ticket?
A mobile CCTV unit took a picture of my car parked in a back street in Romford centre 2 weeks ago with 2 wheels parked on a curb to allow other traffic to pass whilst unloading chemicals into a place of business. I have since recieved £100 fine. The vehicle was there for no longer than a minute. Is there anything I can do to appeal this? The road has a single yellow line, the incident was 10.00am on a Sunday morning.
Parking on a kerb is enforceable by a PCN - even if you did it to avoid blocking the road. The argument is you may have been blocking the path causing an obstruction to people with a disability, people with pushchairs and pedestrians who have a right to be there. Ironically had you not parked on the kerb and were loading then you would not have received the ticket in the circumstances you outline.
You can try an appeal to the issuing authority (which will not incur any additional penalty) but if they reject it then an appeal to the adjudicator is likely to fail as there is a clear breach of the regulations by parking on the kerb.
