Council penalty charge notice for failing to give way to oncoming vehicles
Representations against PCN for failing to comply with a give way to oncoming vehicles sign. My mother received a PCN for the above offence from Lambeth council. I have checked the online photos of the supposed offence and we would like to challenge the PCN on the basis that the oncoming car was a considerable distance away. I am going to request the video footage of the incident. Is there a good chance of success when video footage is requested in these circumstances and we argue that the oncoming car was a significant distance away. We were unaware that councils had the authority to do this and don't they have to advertise the fact that PCN are being issued against such contraventions.
London councils are increasingly taking the lead on traffic offences in the capital which is permitted by Act of Parliament. They have circumvented the law somewhat by dropping the penalty points and increasing the penalty fine to a higher level. Box offences, red route offences and parking are all being enforced by camera operators.
In this particular case you should obtain the video evidence and it is certainly worth a challenge.
It is debatable whether camera operators have sufficient training to decide whether to bring such "value judgement" cases.
