Cyclist run over on footpath

by Conrad Murray last modified 2007-03-18 13:47

My au-pair uses my spare cycle and was riding along the path last week as she felt was safer to do so (no cycle paths and this part of road cars park along sides and through the middle). A car turned in from the road to cross the lowered footpath to enter a gym car park and struck her. My bike is now in 2 pieces and she has bruises to her legs. I had to take time off work getting quotes, visiting police. We are going through driver's insurance company. Will they be liable for full 100% even though she was cycling slowly on a path?

The insurers of the other driver may well be liable for both the replacement cost of the bike (but they may not want to pay what you would consider to be the full value) as well as the injuries to the au-pair girl.  They may not be liable on a 100% basis but this depends entirely on the facts of the matter.

The bike may also be covered under a house contents policy and depending on the terms this may pay on a "new-for-old" basis which could be preferable for you.  If you use an insurance broker, you should seek to find out what effect such a claim would have on your next premium before claiming however.
