Driving in a coned off area
My seventeen year old son was stopped by the police for entering a coned off area on his motorbike. No people were working in the area at the time. He was given a warning but cannot remember exactly what the offence was. He has only held a full licence for a short time and admits to the offence which took place in queuing traffic. He did not sign anything and was given any paperwork. How long does he have to wait before he hears anything and does he need to get legal advice in order to try and keep his licence?
It sounds very much as though your son was given a verbal warning and won't hear anything more. Had there been workers in the area the police may have taken more severe action.
The offence committed was of "Contravening a temporary prohibition due to public works" and while it is a prosecutable offence, it is normally dealt with (if at all by other than a warning) by a non-endorsable Fixed Penalty Notice which he would have been given at the time.
Such FPNs do not place his licence at risk. In the unlikely event that your son does receive a summons he is entitled to request that an FPN would be the most appropriate punishment which would at most incur the payment of a fine.
