Fleet operator question: splitting hire costs between two accidents

by Conrad Murray last modified 2006-12-20 10:59

One of our company cars was involved in two accidents, the second one the day after the first. Neither was our driver’s fault. We have hired another vehicle. How can we split the hire between the accidents? GM, Newark

The roadside lawyer answers:
First, it is clear that the vehicle was driveable after the first accident otherwise it could not have been involved in the second one.

If the second accident made the car undriveable, then most of the hire cost will be attributable to the second accident with just a few days down to the first one and your own insurer’s engineers should be able to advise on this.  They will have to consider the point as your insurers will be seeking to recover their outlay from the insurers of the two other drivers responsible.
