I failed to tell my insurer that I had points. I have since been stopped by a policeman: what happens now?
I forgot to tell my insurance company (MoreThan) that I have points. I was pulled over this morning and the officer asked if I had told my MoreThan about my points. My answer was yes, however, after thinking about it, i realised I hadn't told them. What can happen now ?
The chances are the police will not check with the insurer on the points issue and he was just seeking to make a point, especially as you will show up on their system as insured.
However if you were involved in a collision this evening then MoreThan may refuse to indemnify on the grounds that you have failed to disclose a material fact - in effect that by having points that you are a greater risk than you have declared to them.
Our view is that you will still be insured but were you to have an accident then MoreThan would be justified in claiming the shortfall in premiums - the difference between the amount you should have paid had you declared the points and the amount you actually did pay. This amount would be payable from the time the offence occurred so could cover a number of years if you have been with the same insurer.
