I have received a FPN for holding a mobile phone whilst at traffic lights. Is this the same offence as using a mobile phone whilst driving?

I have received a Fixed Penalty Notice for holding a mobile phone while at the traffic lights. It's a hands free phone and I wasn't using it, I had just taken it out of the cradle as I had almost reached my destination. Is this the same offence as using a mobile phone while driving? Is there any point in appealing?

Holding a mobile phone whilst driving is not an offence. The only time it is an offence is if you are using it whilst holding it and whilst driving. We can help you defend this, if you want to take the matter to Court come back to us. Bear in mind if you are convicted at Court you will get a higher fine and Court costs, but the points will be the same.
