I have received a NIP for allegedly speeding. The problem is that I have never even heard of the place where I was allegedly speeding and have never been there. I was at home at the time of the offence. What should I do?
I received a 'notice of intended prosecution' from North Wales Police for allegedly doing 36 mph in a 30 mph zone on the A5 Berwyn Road, Llangollen, Denbighshire. The letter states they have photographic/video evidence and the car details quoted appear to be mine. However, I have never even heard of this place, never mind been there! My main concern is with proving that I was not in the above location at the time of the offence, as I was alone in my own home in Lancashire at the time. Also, should I complete the S172 form and return it? There is a section to complete re: 'if you were not the driver' but the only options to choose are either a) that I can provide them with the actual driver's details, b) that I represent a hire company or c) that I wasn't the legal owner/keeper. Therefore, there doesn't appear to be an option to choose which simply tells them that I have no idea who was driving that particular vehicle.
Do you own a car with that registration number?
Could anyone else have been driving your car in that location?
If not, it sounds like a cloned registration number plate. Explain the difficulties that you are having and ask for a copy of the photo so you can figure out if it is your car. Be careful because failing to provide the information if convicted carries a big fine and six points.
