I have received a NIP for speeding but on that date I and my car were elsewhere. I believe my car may have been cloned. How should I proceed?
I have received a Notice of Intended Prosecution for speeding with the registration of my car on it. However, the offence was committed on a date/time and location when I and my car were elsewhere. My conclusion is that either my car has been cloned or the registration has been used illegally. Can you please advise as to how I ought to proceed i.e. should I return the form stating this and ask for photo evidence? How can I alert the DVLA that this may be the case?
If you weren't the driver at the time of the alleged offence then you need to return to the fixed penalty unit / safety cameras unit indicating this.
You need to point out that it wasn't your car involved if you are absolutely certain that this is not a possibility. Is the place where the offence happened close to where you live / would travel?
Ask for the photographic evidence to ascertain whether or not it is your car involved. If it is your car from the photos then you will need to be very careful because failing to give the information as to the identity of the driver carries six points.
If you genuinely believe your car registration might have been cloned then tell the police and the DVLA and keep copies of any letters sent.
Come back to me if you get summonsed for any offences.
