I have received a NIP for speeding but the calibration certificate appears to be out of date. Will this help my case?

I have received a NIP in relation to an alleged speed of 102mph. On the NIP the date of the next calibration due is 04/05/2008. Can this help my case as it would appear to be out of date? I have three points already.

You are at risk of a discretionary ban for this speed. The ban can be anything up to 56 days.

If the annual calibration certificate is out of date then you can win your case on the basis that the device isn't being used in accordance with Home Office approval. Come back to me if you are interested in instructing us to act on your behalf and I will do a free advice call with you.
