If a job requires a maximum of 3 penalty points and I have 6 penalty points but with three points soon to reach three years old, should I apply for the position?

I currently have 6 points on my driving licence (cameras) one of which will be three years old shortly. I want to apply for a job which requires only 3 points. I understand that the points last 3 years but actually stay on the licence for 4 years. What is my position?

The points stay on your licence but are effectively spent after three years. The reason it works this way is points count from the date of offence so if you have prosecutions pending then some points already on your licence may overlap with them.

Employment is subject to contract law and you need to outline your precise position with your employer and discuss whether they are willing to accommodate you. If you can show you have no prosecutions pending you are more likely to succeed in persuading them to employ you but you also need to remember that if you commit another offence you may be out of a job.
