If I buy my tax disc online so the car is continuously taxed can I still be prosecuted for failure to display while it is posted out to me?
If my Tax Disc runs out on the 31st of the month and on the 31st I renew my tax online can I still be penalised for not displaying my up to date disc even though it will not be in my possession for a few days while I await postage of the item? I know the law is to display, but without the disc itself, this is impossible. Has the law been updated to deal with the updates of technology?
You can still be prosecuted for the failure to display. The online system is designed for people to renew ahead of expiry not for people needing a disc immediately because they have just bought the car or it has expired.
However your car will show up as taxed on the system so any detailed checks will reveal the true position - that the vehicle is taxed. The problem comes if you are not there and a police officer or traffic warden writes a ticket at the roadside. You will have failed to display and while the court may show leniency if the position is explained you have committed an offence and you will have all the hassle of going to court and persuading them.
