If the camera van is illegally parked will that invalidate the ticket? Do the police take into account the possible inaccuracy of speedometers?

I was doing 47mph in a 40mph limit by a mobile van speed camera which was parked on white line. Is it legal for them to park there to do this as this means parking should not take place. Do the police also take into account my having a older car where the speedometer could be inaccurate (say by 5mph).

Where the van was parked is largely irrelevant and the court will only be interested in whether the van caught you speeding or not.

With regard to the speed the police record (usually very accurately) your actual speed but allow for a substantial margin of error within your speedometer. In the case of a 40mph limit prosecution would not have taken place were you travelling at 46mph as 47mph is the minimum required under ACPO guidelines.

Enforceable limits are Speed limit plus 10% plus 3mph so in your case 40 x [limit x 10%] +3mph= 47mph.

Depending where the offence took place though you may be eligible for a speed awareness course at this speed which means you can avoid the penalty points and fine. These are normally worth undertaking as you will also avoid the five year penalty points bring in terms of insurance premiums.
