I am afraid he will have to pay it. There are occasions when it is legitimate to use the bus lane but the route being blocked by a vehicle waiting to turn right is not one of them. The specified occasions in permitted hours are: when you need to cross it i.e. to avoid an accident, when you are directed to do so by a uniformed police officer or when you are turning at traffic lights/road junctions.
