My friend drove my car after I had a few drinks and was caught speeding. He's not insured for my car. If I name him as the driver will I be prosecuted? What's the best thing to do?

My friend offered to drive my car after I had a few drinks. He was caught speeding with a speed camera. He's not on my insurance policy. If I give his name as the driver of the vehicle will I be prosecuted for him not being on my insurance policy? What's the best thing to do?

You must tell the truth otherwise you run the risk of being prosecuted for peverting the course of justice.

You should name your friend as the driver and if he accepts the offence when he is written to by the police that might be the end of it.

It's unlikely that they will look into the issue as to whether or not he was insured as long as he has a driving licence.

If they do look into it he could get prosecuted for driving without insurance and get 6-8 points and you could get prosecuted for permitting him to drive without insurance which carries the same number of points.

You have a defence if you made it a pre-condition of use that he was insured at the time he drove.
