New driver: recovering a licence and implication of any future points

by Murdo Maguire last modified 2007-02-15 10:27

I am a new driver still within my probationary period and as a result of a second speeding offence the DVLA have revoked my licence for getting 6 points. What procedure do I have to follow to get my licence back again and what are the implications if I receive any additional points in my next probationary period.

The Road Traffic (New Drivers) Act 1995 reverts your driving status back to learner, so you must follow the same procedures as a first time applicant ie pay the current application fee for a new provisional licence and then apply for the test. An exchange fee will also be charged when converting the provisional to full. A full licence cannot be granted to you until you obtain a provisional licence and passed the relevant driving test.

Full entitlement to all categories of vehicle previously held will only be reinstated upon passing a test in any one of the driver's previously held entitlements. A successful test for entitlement to a category of vehicle not previously held will result in a full licence for that category only.

The penalty points she received will still count, but only in terms of the new drivers regulations if she offends again (ie if she gets any more points they will revoke it again).
