Overseas driver caught on camera for red light offence: what happens next?

by Conrad Murray last modified 2007-10-23 06:36

I am sure I was caught on camera going through a red light. I was just not paying enough attention, which I know is hardly an excuse. The lights had just turned and I did not react quickly enough to brake. I have a UK registered car but a Republic of Ireland driving licence as I relocated to the UK a year ago. Can you please tell me what I should expect to happen now? Will this involve a court appearance?

If you were caught you should receive a Notice of Intended Prosecution within 14 days of the incident. You will be initially offered a fixed penalty for 3 points and £60 but once you inform them you have an Irish licence you will be told you have to go to court unless you apply for a UK counterpart for your Irish licence.

If you do not apply for the counterpart (and they cannot make you - you are perfectly legal without doing so) they cannot apply the points and while the case will have to go to court you can plead guilty by post in which case you are only likely to get the fine plus perhaps £25 costs.

If you do apply for a UK counterpart in the next four years the points will be applied to it. You need to inform your insurer of the offence whether you take the penalty points or not.
