Police car accident: claim for distress and trauma?

by Conrad Murray last modified 2006-12-21 11:02

My car was recently written off by a police car on an emergency call. Although my car is being replaced do I have a claim for the trauma and distress caused to me and my family?

Answer

Unless any of you was injured, you will have no claim for trauma and distress. If you were in the car at the time, there is a possiblity of a psychological injury claim assuming medical evidence will support this.

You may however have a claim for loss of use of your vehicle for any period where you were either without transport or had no courtesy vehicle supplied.
