Van fleet question: unable to claim against legal expenses insurance

One of our company vans was parked outside the driver’s house recently when it was hit by another vehicle apparently at some speed. As apparently the accident was caused by a tyre blow out, our legal expenses insurers tell us we haven’t got a claim. Can this be right? DP, Taunton

This advice would fall under the ancient Latin maxim Bollux!  Whilst it is correct that one has to prove negligence in every case, you should be able to establish that the driver was unable to control his vehicle.  One cannot guarantee success, but there is a very good chance of succeeding.
