'Wrong' lane on roundabout results in collision. Who is liable?

by Murdo Maguire last modified 2007-01-09 19:20

I entered the roundabout and was on the inside lane attempting to turn right. A vehicle struck my car on the back right side of my car as he was had just entered the roundabout in an attempt to go straight ahead. Am I liable in this case?

Very difficult to judge without knowing the positions in the road and the relative movements of the vehicles. You can be in what is theoretically the wrong lane but providing you are signalling correctly and clearly indicate your intentions and don't make sudden manoeuvres you might safely travel in the direction you wish to go. The issue is likely to be your relative positions in the lanes at the point of impact. For this reason collisions on roundabouts are often settled by insurers on a 50-50 liability basis.
